Another Summary Judgment!

Jeff James and Jason Rossiter, assisted by paralegal Tana Daugherty, obtained another summary judgment for our client Confluence Health on August 17, 2018.  The case, Kathy Allstot v. Confluence Health and Central Washington Health Services Association, filed in federal court in the Eastern District of Washington, was brought by a former employee alleging wrongful termination in violation of public policy, disability discrimination, failure to accommodate, retaliation, and interference with the exercise of FMLA rights.  The trial judge carefully parsed through the allegations to ultimately conclude that the plaintiff had no evidence to support her claims.  In his decision, the judge noted the efforts of her manager and human resources personnel to help her succeed through verbal coaching, written warnings, and placing her on a last-chance agreement.   Ultimately, her employment was terminated when she continued to make errors.
