Jeff James and Julian Cano succeeded in getting dismissed a putative class action before it got off the ground. The plaintiff sued her former employer, a public hospital district, claiming it did not follow the meal and rest break rules set forth in WAC 296-126-092. Jeff and Julian demonstrated that the employer changed the rules pursuant to a collective bargaining agreement, something that the law permits public employers to do. As a result, the court tossed the claim before plaintiff could engage in costly class-wide discovery.
